Party guests and visitors

Guest participation waiver.

Who needs to complete this

Every child who takes part in a birthday party, open gym, trial class or other one-time visit at Cypress Pointe needs a participation agreement on file before they step on the floor. If your child is already enrolled at Cypress Pointe, you accepted this agreement at registration and do not need to fill it out again. For everyone else, a parent or legal guardian reads the agreement below, fills in the short form, and submits it. It takes about three minutes. One adult cannot accept for another family's child, so please send this page to each guest family.

Landrum Athletics LLC d/b/a Cypress Pointe Gymnastics ("CPG" or the "Gym") · 165 E. Hickory St., Ponchatoula, LA 70454 · (985) 386-4966 · office@cypresspointegym.com

Participation Agreement

PLEASE READ CAREFULLY BEFORE ACCEPTING. This Agreement affects legal rights. It must be accepted by every adult participant, and by a parent or legal guardian for every participant under 18 years of age, before participation in any recreational class, preschool class, private or semi-private lesson, camp, clinic, open gym, parents' night out, birthday party, tryout or evaluation, guest visit, day pass, special event, or other activity at or sponsored by CPG (collectively, the "Activities"). It covers both enrolled participants and one-time guests, see Section 1. It is presented and accepted electronically, and no handwritten signature is required.

1. Scope and application

Enrolled participants. This Agreement applies to every Participant enrolled on the accepting adult's registration account and to each of the Activities in which they take part. It remains in full force as Participants enroll in additional or different Activities, without need for re-acceptance, until revoked in writing. Participant names, dates of birth, program enrollment, medical information, emergency contacts, and authorized pickup names are provided and kept current by the accepting adult in the registration account, and are incorporated into this Agreement by reference.

Guests and single-event participants. A participant taking part without an enrolled account as a birthday party guest, a kids' or parents' night out guest, an open gym drop-in, a trial or free class, or on a day pass is covered by this Agreement for that event only (the "Event"). It must be accepted by the guest if 18 or older, or by the guest's own parent or legal guardian; one adult may not accept this Agreement for another family's child. A guest who later enrolls accepts this Agreement again at registration under the paragraph above.

2. Acknowledgment and voluntary assumption of risk

I understand that gymnastics, tumbling, trampoline, and related athletic activities are inherently and unavoidably dangerous. Risks arise from the nature of the sport itself and cannot be eliminated even with proper instruction, supervision, spotting, and equipment. These risks include, but are not limited to: falls from apparatus or at height; landing on the head, neck, or back; collisions with equipment, mats, walls, or other participants; over-rotation or under-rotation of skills; equipment failure; and the negligence of other participants or spectators. Possible injuries include, without limitation, sprains, strains, bruises, cuts, broken bones, dislocations, concussion and other head injuries, heat-related illness, PARALYSIS, PERMANENT DISABILITY, AND DEATH.

I acknowledge that I have full knowledge of the nature and extent of these risks, that participation is entirely voluntary, and that I (and the minor Participant(s)) KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, arising out of or related to the Activities, including risks present while on the premises as a spectator. I further acknowledge that guests and drop-in participants are not evaluated for skill level beforehand and may be taking part in gymnastics for the first time.

3. Release of liability and covenant not to sue

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, I, for myself and on behalf of the minor Participant(s), my spouse, heirs, assigns, personal representatives, and next of kin, HEREBY RELEASE, WAIVE, AND DISCHARGE Landrum Athletics LLC d/b/a Cypress Pointe Gymnastics, its owners, members, officers, employees, coaches, instructors, volunteers, agents, landlords, and sponsors (collectively, the "Releasees") from any and all claims, demands, losses, and liability arising out of or related to participation in the Activities or presence on the premises, INCLUDING ANY CLAIM ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASEES, and I covenant not to sue the Releasees for any such claim. This release does not extend to gross negligence, intentional misconduct, or any liability that cannot be released as a matter of law.

Nothing in this Agreement is intended to waive or limit any right or remedy that cannot lawfully be waived or limited in advance under Louisiana law, including Louisiana Civil Code article 2004; to the extent any provision would do so, it is limited to the maximum effect permitted by law, and the remainder of this Agreement is unaffected.

4. Indemnification

To the fullest extent permitted by applicable law, I agree to indemnify, defend, and hold harmless the Releasees from and against any claim, demand, or cause of action, including reasonable attorneys' fees and costs of defense, brought by me, on my behalf, or by any third party arising out of my (or the Participant's) participation in the Activities, my breach of this Agreement, or my (or the Participant's) failure to follow Gym rules or staff instructions.

5. Medical authorization and financial responsibility

In the event of an injury or medical emergency, I authorize CPG staff to administer first aid and to obtain emergency medical treatment for me or the Participant(s), including transport by emergency medical services to a hospital or other treatment facility, if I (or another parent/guardian) cannot be reached promptly. I authorize licensed physicians and medical personnel to provide treatment deemed necessary. I understand that CPG staff are not medical professionals.

I understand and agree that CPG DOES NOT PROVIDE MEDICAL, HEALTH, OR ACCIDENT INSURANCE for participants, and that all costs of medical care, treatment, and transportation are my sole responsibility and/or that of my own health insurance. I certify that the Participant(s) have no medical condition that prevents safe participation, and I agree to disclose all relevant medical conditions, allergies, and medications in the registration account or on the guest acceptance form, to keep that information current, and to provide a phone number at which I can be reached.

6. Gym rules, safe participation, and pickup

I agree that the Participant(s) will follow all posted Gym rules and the instructions of coaches and staff, will not use equipment without supervision, and will participate only in activities appropriate to their instruction level. Adults present remain responsible for supervising their own non-participating children in the lobby and viewing area. I understand that CPG may, in its sole discretion, suspend or remove any participant whose behavior presents a safety risk to themselves or others, without refund of fees for the affected session or Event. A Participant is released only to me or to a person listed as authorized on the registration account or guest form.

7. Photo, video and media release

I grant CPG permission to photograph and record the Participant(s) during Activities and to use such images, video, and audio without compensation and without further approval for the Gym's promotional purposes, including its website, social media, brochures, and news coverage. No participant will be identified by full name without separate consent. This grant continues until revoked in writing (revocation applies prospectively only). Opt out: to decline promotional use of my/my child(ren)'s image, I will select the media opt-out option on the form below or notify the Gym in writing. Participation is not affected.

8. General provisions

Severability. If any provision of this Agreement is held invalid or unenforceable, that provision shall be enforced to the maximum extent permitted, and all remaining provisions shall continue in full force and effect. Governing law and venue. This Agreement is governed by the laws of the State of Louisiana. Exclusive venue for any dispute lies in the courts of Tangipahoa Parish, Louisiana. Entire agreement. This Agreement is the complete and exclusive statement regarding its subject matter, is accepted electronically as provided in Section 9, and may only be modified in a writing signed by CPG.

9. Electronic acceptance

Enrolled participants accept this Agreement in CPG's online registration system; guests accept it through this guest form or at the front desk. By checking the acceptance boxes, typing your name, and submitting the form, the accepting adult adopts that action as their electronic signature and agrees to be bound by every term of this Agreement, including the assumption of risk, release and covenant not to sue, indemnification, and medical authorization in Sections 2 through 5. No handwritten signature or initials are required.

Record of acceptance. The system records the accepting adult's name, the guest record, the relationship to the Participant, a contact phone, the date and time of acceptance, and the version of this Agreement then in effect. That record is the parties' evidence of acceptance and has the same force and effect as a handwritten signature under the Louisiana Uniform Electronic Transactions Act (La. R.S. 9:2601 et seq.) and the federal E-SIGN Act (15 U.S.C. § 7001 et seq.). Participant identification, medical, and emergency contact information is collected in the same record.

Certification. By accepting, I certify that I am at least 18 years of age; that I am the Participant, or the parent or legal guardian with legal authority to accept this Agreement on behalf of each minor Participant named below; that I have read this entire Agreement; that I understand its terms, including that it assumes risk of serious injury and releases claims; and that I accept it freely and voluntarily without inducement. A printed copy is available from the Gym on request.
